TERMS OF USE

These terms of use, available on our website: www.extraweek.hr, represent the basic elements of your contract with EXTRA WEEK. When you make a payment and obtain confirmation from EXTRA WEEK, the contract between you and EXTRA WEEK automatically comes into force. These terms of use do not apply to special contracts that you might conclude during our journey. EXTRA WEEK retains the right to amend these terms and provisions at any time, without prior announcement. These amendments come into force at the time of updating of the terms of use on our website EXTRA WEEK (www.extraweek.hr).

This document contains the standard terms of reservation for EXTRA WEEK.

DEFINITIONS AND MEANING

In these terms of use, unless contracted otherwise, the following expressions have the following meanings:

• “we”, “our” “us” – EXTRA WEEK
• “you“, “your” – All persons on the booking list, and all persons who might be subsequently added, i.e. all persons who fully paid for our journey
• “journey”, “vacation” – All services that you have contracted with EXTRA WEEK

It is considered that the words that are used in the singular form in these terms of use include the plural form and vice versa. Also, any references to one gender include the other gender as well, as well as all derivatives from grammatical cases and other forms of these words. The titles used in these terms of use are used for stylistic purposes and do not have any influence on the actual interpretation of these terms.

RESERVATIONS AND PAYMENT

The reservations can be made through our website, through direct contact on info@extraweek.hr or through sales agents. The reservations are considered informative and non-binding until the full receipt of your payment and our confirmation of payment, i.e. the moment when we issue you the invoice for your payment.   

The persons making a reservation must be at least 20 years old or must have their 20^th birthday in the year of the journey and fulfill the conditions for execution of payments and contracting of reservations.   

For the reservations of the entire sailboat, the head of the group must deliver us the list of all crew members at least 40 days before the departure. All communication and dealings will go through this person. His or her responsibility is to make sure that everyone is aware of the important elements of communication. 

The payments are made in full, at least 40 days before the departure. All incomplete payments will be returned to the client under the assumption that he or she cancelled the journey unless otherwise is subsequently agreed. 

TIME OF COMMENCEMENT AND CONCLUSION OF THE JOURNEY

The time of departure is on Saturday between 5 p.m. and 7 p.m. in Marina Kaštela. The registration commences on Saturday from 12 p.m. in Marina Kaštela. Our journey concludes on the following Saturday, and you all must check out at latest by 9 a.m. 

CONTRACT

These terms of use represent a contract between you and EXTRA WEEK. The obligations between you and EXTRA WEEK come into force on the moment when you make a full payment or when a person who made a full payment receives a confirmation from us. The contract is concluded pursuant to the Croatian laws. The Commercial Court in Zagreb has jurisdiction over all possible disputes. 

AMENDMENTS

We retain the right to amend any possible marketing errors until the moment of receipt of the payment. You are obliged to immediately inform us of any amendments on your side. We will try to avoid any expenses arising from the amendments to the persons who are traveling, except in cases when we must amend the pre-made promotional material that cannot be transferred to other persons. 

ITINERARY

You fully accept that the skipper assigned to your vessel will operate the vessel and make all decisions regarding the vessel. An itinerary was made for your journey. Your safety is our primary concern, and EXTRA WEEK may at any time deviate from the itinerary and change the route without prior announcement. During the sail, the skipper retains the right to change the direction of travel for any reason, but particularly when this is in the interest of health and safety of the passengers. Whether it is unfavorable weather conditions, sea conditions or any other aggravating circumstances that may endanger your safety, or some other reason why we think your route should be changed. If because of exceptional circumstances the planned return to the marina cannot be completed, EXTRA WEEK is not responsible for any newly accrued expenses of any kind. 

DOCUMENTS

It is your responsibility to have with yourself valid necessary IDs and travel documents. If we establish an irregularity or invalidity of your travel documents or necessary IDs, we have a full right to prevent you from participating on our journey, even though you fully paid for it. EXTRA WEEK cannot help you to obtain travel documents, visas or other documentation necessary for the participation in our journey. 

CANCELLATIONS

YOUR CANCELLATIONS

If for any reason you wish to cancel your journey within 48 hours from the payment, we will return the full amount of the payment. Once you pay for the journey, we make a commitment to other participants, skippers, suppliers, all for the purposes of ensuring you enjoy the best vacation possible. If you wish to cancel the journey for any reason after the expiration of the 48 hours deadline, we are not obliged to return you the money nor are we responsible for your cancellation and incurred loss or damages. EXTRA WEEK does not allow the resale of its products and services.   

OUR CANCELLATION

The target user group for EXTRA WEEK services is 20 to 40 years of age.

If you are older than 40, EXTRA WEEK retains the right to cancel your reservation for safety and health reasons. In this case, we will inform you and return you the full amount of money paid. Although we try to avoid cancellations, sometimes they are inevitable, and we must retain the right to them. EXTRA WEEK has the right to cancel its service, i.e. journey to anyone and at any time, without prior announcement and additional explanations, and with a return of the full amount of money paid. 

FORCE MAJEURE

Unfortunately, we cannot be responsible for the non-performance of the contractual obligations in the event of “force majeure”. For this purpose, “force majeure” are the circumstances that could not be avoided or foreseen, such as storm, strong winds, nuclear disasters, civil unrest, terrorism, industrial disasters, fires, floods, hurricanes and other similar natural disasters that we cannot control. 

RESPONSIBILITIES

EXTRA WEEK will fulfill its contractual obligations in the best way possible, for the purpose of providing the perfect service. Unless we violate the contractual obligations, the journey is undertaken exclusively at the responsibility and risk of each individual passenger. The purchase of our service is made exclusively at personal responsibility and you accept the responsibility for all damages and issues that may arise from your non-observance of contractual obligations or actions that are not in line with the policy and character of this type of journey. EXTRA WEEK waives all responsibility for any damages, injuries or loss that might be incurred that were caused under the influence of alcohol and drugs. EXTRA WEEK fully retains the right to exclude you from the journey at any time if you are found to be in the possession of narcotics or other illegal substances or illegal firearms, and it has the right to inform the relevant legal authorities. In this case, we are not obliged to refund you or cover the incurred expenses. At this moment, the contract between you and EXTRA WEEK is terminated. You are fully responsible for all your personal belongings and property. 

EXTRA WEEK is not responsible in any way for any damages, loss, expense, injury, illness or death in the case of your legal claim, if it involves: actions of any third parties, actions or failure to act of our employees if it represents a breach of their contractual obligations to us, incorrect information provided by you, actions or mistakes of our suppliers, actions or failure to act of third parties that are not acting in the capacity of implementation or organization of contracted journeys, any “force majeure” events. 

Our liability and expenses in event of a successful legal claim may not surpass the price of the journey that you have contracted, i.e. 898 € for woman or 989 € for man, minus the insurance payments. 

BEHAVIOR AND EARLY TERMINATION OF THE AGREEMENT

During your stay on our journey, you are expected to exhibit a responsible level of behavior and responsibility and you must observe the rules and regulations relating to the boats. You will be responsible for any damages or loss caused to you or other persons while you are on the boat. If you or any other person from your crew acts inappropriately in our opinion, if you can in any way cause danger to yourself or the others or disturb any third party or property, if you violate local regulations and abuse or threaten or cause in any other way a public discomfort or play music in marinas after 8 p.m., we have the right to terminate our contract at any time with such person or persons, without prior announcement or any refunds. Because of the behavior mentioned above, the skipper has the full right to stop working at any time. We also have the right to exclude a person or persons from our boat at any time, if they participate in our opinion in the inappropriate behavior mentioned above. We will have no further obligations to such person or persons, and we will not be responsible for the expenses that they incur. At this time, the contract between you and EXTRA WEEK will be terminated. EXTRA WEEK retains the full right to prevent you from participating in any of our future journeys. 

RETURNS

We will always try to provide you with the best vacation possible, but if issues arise you need to report them as soon as possible to the manager of the charter company or the skipper, who will try to resolve them immediately. Non-compliance with the above may result in the loss of your indemnity claim.   

RIGHT TO USE PHOTOS AND VIDEOS

Keep in mind that we use actual participants of our journeys, i.e. all of you who participated in them, in all our promotional materials, advertisements and other materials for public promotion. EXTRA WEEK has the right to take photograph and film you during your journey for the purpose of advertising and promotion. By making a reservation and full payment you consent to EXTRA WEEK collecting and using such materials depicting you. You also consent to EXTRA WEEK modifying the collected materials in the form of cutting, changing, combining and other forms of editing. EXTRA WEEK has exclusive ownership of all rights to this material. You also consent that the materials may be used for commercial purposes or for sale. EXTRA WEEK has the right to issue, approve or transfer to a third party the rights and ownership of the materials, either for commercial or personal use. If you do not wish to be depicted on the photographs or videos, you must inform EXTRA WEEK via info@extraweek.hr before the commencement of your journey. The message must contain your name and surname, date of birth, account number i.e. the number of reservation and your contact data. 

By making the full payment you also accept that all photographs and videos that you record during your journey will be used exclusively for personal purposes, i.e. for your social media, and not for commercial purposes.    

TRAVEL INSURANCE AND MEDICAL ISSUES

The basic condition for all persons who use our services is to obtain a personal travel insurance policy. It is your responsibility to obtain the travel insurance policy yourself. Of course, this policy should cover adventurous activities such as sailing. By making a reservation you consent that you and the members of your crew will have comprehensive travel insurance during your entire journey. Your responsibility is to consult your doctor so you can be sure that you are physically capable of spending a vacation with us. You must inform us before the journey if you or any member of your crew suffer from any kind of medical condition that might affect your vacation. You must always have with you the medicines that you need. Also, you must inform us in writing of any special requests at the time of the reservation, and we will try to fulfill them to the best of our abilities if we consider them appropriate. You may not sail during the influence of alcohol or drugs.

EXCURSIONS, ACTIVITIES AND WEBSITE INFORMATION

We cannot guarantee with 100% certainty that the information that we offer on excursions and other activities in places that we visit are correct, and they are not a part of our contract. Excursions and all other activities that may be paid and used while you are on a journey are not a part of our journey and contract between you and EXTRA WEEK. EXTRA WEEK is not responsible for anything that happens during these excursions or activities.

DETAILS ON BOATS

The pictures of boats on our website are of informative nature. The discrepancies between the boats shown on our website and the boat that will be assigned to your journey are possible. Also, the content shown is not a guarantee of the overall boat inventory and is only shown as a sample of the boat inventory.   

EXTRA WEEK PRIVACY RULES

We retain the right to amend these terms and conditions without prior announcement of the publication of new terms and conditions on this website. We do not offer any warranties regarding the accuracy of the information contained on our website. Your use of this website and any dispute that might arise from such use are subject to the laws of the Republic of Croatia.

COLLECTION OF PERSONAL DATA

We will obtain your personal data through correspondence, email, when you fill out a reservation, send us an inquiry, create an account on our website, write a suggestion or comment, fill out our form. or you send us any detail, when you log in with use for commercial notices, request information on sales or any other information. We also have the right to record your call and any other form of correspondence with you. This data may be kept for as long as we deem necessary and use them for our purposes. 

In order to process your reservation, we collect your personal data together with the information that we learned about you during any form of communication with us and through your use of our website. These details may include the names and surnames of passengers, username, marital status, nationality, sex, email, phone numbers, social media profiles, addresses, ID card or passport numbers, phone numbers, email and all data related to the payment and all types of transactions. We also may collect data on your medical condition. If you deliver us information and data on someone else’s behalf, we will consider that this person gave you permission to do so, and you will be responsible for sharing their data. By this, we mean that the other person gave approval for the collection and processing of his/her data.

Your data may be used for the following purposes: execution of the contract, provision of requested products and services, contact for details regarding EXTRA WEEK product, weather changes, statistical and marketing analyses, various promotions, system testing, client questionnaires, communication with clients and provision of services and products that we believe might be of interest to you, various email notifications, and whenever this is necessary to advance our legitimate interests. Your interests and basic rights do not supersede these interests, even when we need to fulfill the legal and regulatory obligations.

Keep in mind that your personal data may be processed without your knowledge and consent, pursuant to the rules from our terms of service mentioned above if this is necessary and legally permitted. 

We cannot guarantee the safety of your personal data. You send your personal data fully at your own risk. We cannot be responsible for any form of damage, loss or expenses that you have incurred by sending your personal data to us in any way. 

SHARING YOUR INFORMATION

We follow strict security protocols when storing and disclosing information regarding you, our passengers. The information is used to provide the best possible service to you. We may disclose your information to public entities or entities for implementation of laws, pursuant to legal conditions. We also transfer your data to charter companies and port authorities so that all members of the crew may sail out and spend time on the boat during the journey.   

MY EXTRA WEEK ACCOUNT

All data collected after the registration to your EXTRA WEEK account will be used pursuant to this privacy statement. On your personal EXTRA WEEK  account, we will store all your data such as name, surname, address, email, citizenship, sex, phone numbers, emergency emails and messages and phone numbers of third parties, reservation details and all information regarding the payment. We may also store all the information on your health condition and diet preferences. We may also store the information on your travel and ID documents. 

DIRECT MARKETING MATERIAL

We may occasionally contact you with information on our products and services and various other promotions via e-mail. However, you will have the option to decline to receive such notices.   

WEBSITE TRACKING

We use tracking software to track the traffic patterns and use of the website so that we can improve and enhance our website. By visiting or using our website, you or your computer may give personal data. For the purpose of better management and maintenance of our website, we may collect the following data: details about your visits, IP address, pages that you viewed, resources that you have accessed, traffic data, location data, browser that you use and other communication data.
